La fiscalización municipal es una forma de combatir el comercio ambulatorio; por lo
que el objetivo general de la presente investigación se sitúa en el hecho de analizar
de qué manera la fiscalización municipal controla el comercio ambulatorio en la
Municipalidad de Lima, 2020.
En cuanto a la metodología, esta tesis poseyó un enfoque cualitativo, de tipo
básica, diseño centrado en la teoría fundamentada, aplicación del método inductivo,
descriptivo y hermenéutico, con un nivel descriptivo. El escenario de estudio se
situó en la Municipalidad de Lima, los participantes fueron: fiscales: provincial y
adjunto; asesor de la Fiscalía de la Nación, asistentes en función fiscal, gerentes:
municipal, de control interno, de fiscalización y control, de seguridad; y, subgerente
de autorización comercial de la Municipalidad de Lima. Las técnicas: entrevista y
análisis de documentos; los instrumentos: guía de entrevista y la ficha de análisis
documental.
Por último, como resultado y conclusión se tuvo que, la fiscalización municipal
efectivamente controló el comercio ambulatorio; pues existen múltiples formas de
supervisar las actividades informales que realizan los vendedores ambulantes a
diario; ello sin la necesidad de que se haga uso desmedido de la fuerza, tal como
se rescata de la Ley N° 27444.
