Factibilidad de incluir circunstancias agravantes en el delito de “Grooming” tipificado en la Ley de Delitos Informáticos - Perú

El delito de “Grooming” afecta a la población más joven, el objetivo de esta tesis fue
determinar la factibilidad de incluir circunstancias agravantes en el delito de
“Grooming” tipificado en la Ley de Delitos Informáticos, ello debido a que este delito
establece la agravante cuando la víctima sea menor de catorce años, mas no
establece ciertos supuestos que agravarían más la consecuencia jurídico penal
como la condición del sujeto activo, medios a fin de conseguir su objetivo, entre
otros, siendo necesarios ya que el “Groomer” por medio de las TIC, valiéndose de
diversas tácticas ganan la confianza de sus víctimas para poder mantener un cierto
control emocional a fin de conseguir de ellos imágenes o videos comprometedores
y abusar de ese control; siendo una tesis con enfoque cualitativo, de tipo de
investigación básica, con diseño descriptivo y teoría fundamentada; asimismo, del
análisis de los datos recolectados y posturas doctrinarias, se obtuvo como resultado
la necesidad de incorporar circunstancias agravantes, concluyendo que es factible
incluir circunstancias agravantes en el delito de “Grooming” tipificado en la Ley
30096, lo cual resulta necesario que el derecho penal adelante sus barreras de
protección hacia los NNA.
