El debido proceso frente a la prisión preventiva ex-post sentencia condenatoria

El presente trabajo de investigación tuvo como objetivo se determinó los
derechos y principios del debido proceso, que son vulnerados frente a la prisión
preventiva después de la sentencia condenatoria recurrida, es por ello que se
utilizó el tipo de investigación básico, enfoque cualitativo y diseño no
experimental, incluyendo como participantes abogados litigantes en materia
penal y fiscales representantes del Ministerio Publico, por lo que, los resultados
principales señalan la afectación a principios y derechos que recoge el debido
proceso, por el uso de la figura de prisión preventiva en un estadío posterior a la
sentencia condenatoria recurrida del artículo 274, inciso 5 del código procesal
penal, tornándose en inconstitucional, por lo cual, se debería derogar la
mencionada figura en aquella etapa del proceso, más aun si para la finalidad que
se utiliza, ya se ha regulado otra figura con diferente naturaleza como lo es la
ejecución provisional de la condena. Concluyendo que, la prisión preventiva
después de la sentencia condenatoria recurrida es inconstitucional, toda vez que
contraviene con el debido proceso.
