Análisis de la revisión judicial como causal de suspensión del procedimiento de ejecución coactiva en el Ministerio de Justicia y Derechos Humanos

La presente investigación tuvo por objeto de estudio, el análisis del proceso de
revisión judicial y sus efectos dentro de los procedimientos de ejecución coactiva
en el Ministerio de Justicia y Derechos Humanos. El objetivo general fue analizar
cómo afecta la presentación de una demanda de revisión judicial al Procedimiento
de Ejecución Coactiva en el Ministerio de Justicia y Derechos Humanos.
El tipo de estudio corresponde al enfoque cualitativo, estando dirigido al
análisis e interpretación de las normas y jurisprudencia vinculada al procedimiento
de ejecución coactiva y el diseño es estudio de casos de los expedientes coactivos
del Ministerio de Justicia y Derechos Humanos. Las técnicas utilizadas para la
recolección de datos fueron: las entrevistas a expertos en la materia de derecho
administrativo y derecho tributario, análisis de fuente documental, análisis de marco
normativo, comparado, y análisis de jurisprudencia.
En el estudio se pudo concluir que el T.U.O de la Ley N° 26979, Ley de
Procedimiento de Ejecución Coactiva vigente en el Perú, permite una presentación
indiscriminada de demandas de revisión judicial, por parte de los deudores.
Además ante la interposición de demandas de revisión judicial, el Ejecutor
Coactivo se ve obligado a suspender los procedimientos y levantar los embargos
trabados. Finalmente, la dilación de los Procedimientos de Ejecución Coactiva
afecta directamente el cumplimiento de las metas de recaudación; en el caso
específico de la presente investigación, la entidad afectada es el Ministerio
de Justicia y Derechos Humanos.
