El propósito de este trabajo es brindarles un análisis en relación a la calificación del delito del
contrabando en los terminales del callao por los jueces penales en delitos aduaneros en
contrabando simple y fraccionado. Teniendo presente los antecedentes, definiciones como
generales y específicas, las entidades que guardan relación al presente tema, entre otros.
Teniendo en cuenta que para el contrabando aduanero simple que figura en La ley de delitos
aduaneros N°28008 como el que hurta, evita, quita, usa, organiza. El delito de contrabando se
encuentra regulado por un lado como delito contra la defraudación y por otro contrabando
aduanero, este delito será investigado cuando la mercancía encontrada supere a las (4) Unidades
impositivas tributarias.
Todo contrabando hallado menor de las 4 Unidades impositivas tributarias es considerado
infracción tributaria, que se resuelve administrativamente por la Superintendencia Nacional de
Aduanas y de administración tributaria (SUNAT), por lo cual no existe una clara clasificación
para la descripción y determinación que ayude a distinguir a cada uno como es para el
contrabando simple y fraccionado, el contrabando llamado hormiga cumple un fin de defraudar
en grandes cantidades para beneficio de las grandes organizaciones de crimen organizado.
Es por ello que después de haber realizado las diversas entrevistas a los sujetos de estudios,
hemos podido determinar cuáles son los criterios que ellos utilizan para determinar la calificación
del delito de contrabando en el terminal del callao por los jueces penales en delitos aduaneros.
