La tesis titulada “El Interés Superior del Niño y su Prevalencia sobre la Patria
Potestad de los Padres Biológicos en el caso de Maternidad Subrogada”, se ha
planteado como objetivo general establecer si el Principio del Interés Superior del
Niño Prevalece sobre la Patria Potestad de los Padres Biológicos en el caso de la
Maternidad Subrogada.
La metodología que se utilizó es de tipo de estudio básico, enfoque cualitativo,
debido a que se basa en el estudio de un caso referente al tema investigado,
además de analizar, explicar y evidenciar la ponderación de dicho Principio sobre
la Patria Potestad. Asimismo, se utilizó el diseño de la Teoría Fundamentada,
puesto que, a partir de la recolección y análisis de datos se determinó la validez de
los objetivos planteados.
La presente investigación permitió evidenciar que, la regulación de las Técnicas de
Reproducción Asistida en el Perú, es deficiente, pues no existe una legislación
específica, solo se encuentran artículos dispersos contenidos en algunas normas
generales. A partir de ello, se determina la necesaria creación y positivización de
un ordenamiento jurídico pertinente, de esta manera se brindaría seguridad jurídica
a las partes, tomando en cuenta la ponderación del Principio del Interés superior
del Niño.
