Problemática en la aplicación de la conversión y suspensión en la ejecución de la pena privativa de la libertad en los delitos de agresión en contra de las mujeres o integrantes del grupo familiar

La presente investigación tuvo como objetivo general determinar cuándo la aplicación
de la conversión y suspensión de la ejecución de la pena privativa de la libertad es
proporcional en los delitos de agresión en contra de las mujeres o integrantes del grupo
familiar, en atención a la reciente modificatoria del artículo 57° del Código Penal que,
en su parte in fine prohíbe la suspensión de la pena en este delito, sin contar con un
estudio técnico respecto al sistema penitenciario, o de su respuesta a los principios de
resocialización y de proporcionalidad. La investigación fue de tipo básica, diseño
cualitativo porque se estableció las relaciones teórico-doctrinarias; y descriptiva debido
a que se expuso con fidelidad las características más sobresalientes de la realidad materia
de estudio, teniendo como guía la Resolución N° 0089-2019-UCV y tratándose de un
estudio cualitativo, no cuenta con población ni muestra, las técnicas fueron la entrevista
y el análisis documental, cuyo instrumentos fueron la guía documental y la guía de
entrevistas que permitió recoger, organizar y presentar la información extraída de las
fuentes primarias. Por consiguiente, se concluyó que la conversión o suspensión de
ejecución de la pena en el delito de agresión en contra de las mujeres o integrantes del
grupo familiar, es proporcional y razonable cuando el sujeto activo sea un agente
primario y la agresión física y psicológica es mínima, cuya pena es no menor de uno ni
mayor de tres años (pena corta), ello en virtud, de su comportamiento delictivo menos
lesivo al bien jurídico tutelado y producido en la víctima.
