La investigación en curso se titula “La Exclusión de Beneficios Sociales en contratos sujeto a modalidad por necesidades del mercado en la Micro y Pequeña Empresa en el Perú”, es de tipo descriptivo, su diseño es no experimental. La formulación del problema de investigación es ¿Cómo la desnaturalización de contrato sujeto a su modalidad y la exclusión de beneficios sociales, afectan al trabajador a tiempo parcial? Los contratos a tiempo parcial se deben entender como aquel contrato donde la prestación de servicios del trabajador se pueda desarrollar en un tiempo menor de cuatro horas diarias en promedio. La hipótesis se centra, en cuanto mayor sea la inclusión de los beneficios sociales sobre la labor del trabajador a tiempo parcial, se contribuye a la no desnaturalización de contrato sujeto a modalidad por necesidad de mercado. El objetivo general se enfoca en analizar la necesidad de inclusión de algunos beneficios sociales no contemplados en el ordenamiento jurídico, con respecto a los contratos a tiempo parcial y cuál sería la afectación hacía el trabajador. Se concluye que existe un conflicto de Normas al excluir el derecho de la protección frente al despido arbitrario y al goce de vacaciones del trabajador a tiempo parcial.
