La investigación tuvo como objetivo demostrar si los jueces utilizan algunos criterios
alternativos de solución de los conflictos en los procesos judiciales. Además, tres
objetivos específicos que tuvieron como finalidad, Identificar por qué los jueces
deberían aplicar el análisis económico del derecho para resolver conflictos
judiciales, describir por qué en los procesos judiciales no se alcanza la optimización
de las sentencias judiciales, y describir por qué los jueces deberían aplicar el
teorema de Coase en las decisiones judiciales.
Asimismo, el enfoque de la investigación fue cualitativo, y el diseño adecuado para
responder al problema general fue, el diseño fenomenológico porque fue necesario
entrevistar a expertos en el derecho civil para comprender de cerca el problema de
estudio.
De los resultados encontrados se logró concluir que, la aplicación del Análisis
Económico del Derecho en el sistema jurídico peruano puede tener una relevante
trascendencia para las distintas materias en el derecho, convirtiéndose en una
alternativa para lograr resolver situaciones jurídicas que la costumbre del
positivismo romano germánico había implantado durante siglos dentro de las
normas que rigen los intercambios de titularidades en la sociedad.
