El informe de investigación presentó como objetivo general, analizar de qué
manera la despenalización de la eutanasia garantiza el reconocimiento a morir
dignamente en el Perú, por ello, se planteó como supuesto jurídico que la
despenalización de la eutanasia no está descrita en el ordenamiento jurídico
peruano y por ende debe de existir un enfoque claro y preciso del derecho a la
voluntad a morir dignamente en el Perú.
El método empleado es de enfoque cualitativo, con diseño de teoría
fundamentada, de tipo básica y con nivel descriptivo. Éste va dirigido a distintos
escenarios de estudios con sus debidos participantes como magistrados,
profesionales legales en materia penal y constitucional, así como médicos. Se
empleó las técnicas de recolección de datos como sus instrumentos de guía de
entrevista y la guía de análisis de fuente documental de derecho comparado,
jurisprudencia extranjera y proyecto de ley.
Como resultados y conclusión se planteó que el beneficio que genera la
legalización de la eutanasia es evitar el sufrimiento del paciente con
enfermedad terminal o incurable por la propia enfermedad. Asimismo, el
reconocimiento de la muerte digna es el derecho a cesar la vida por voluntad,
más aún que la dignidad es compatible con la vida en todo momento hasta su
cese.
