Necesidad de punición contra delitos perpetrados por adolescentes en fiscalía penal de Lima-Norte, 2020

Una de las certidumbres más relevantes a la que se arribó en la presente
investigación es la noción de que los adolescentes que delinquen son con
conscientes de sus actos y de sus consecuencias. Empero, esta conciencia de
corrección o incorrección adolece del conocimiento de las consecuencias
jurídicas como afirmaron algunos expertos. No obstante, conforme lo
sustentaron numerosos estudios en otras regiones, los adolescentes actúan
con impunidad porque saben que se hallan protegidos por los ordenamientos
jurídicos. En cuanto a este asunto, cabe afirmar que en Perú existe una
contradicción entre el Código Civil y el Código penal. El primero los considera
capaces para contraer matrimonio a los dieciséis años. Esto se complementa
con la ley de libertad sexual que los faculta para iniciar su vida sexual de forma
libre a partir de los catorce años. Por otro lado, el Código de niños y
adolescentes los ampara con el principio del interés superior del niño. Es más,
el derecho internacional a través de la Organización de las Naciones Unidas
(ONU) y su institución para la educación UNICEF, más la Corte Internacional
de derechos humanos, protege en todos los extremos a los adolescentes.
Finalmente, tenemos un código Penal que considera a los adolescentes que
cometen delitos solo como infractores. Esta impunidad ha favorecido la
proliferación y el recrudecimiento de los delitos perpetrados por adolescentes,
conforme se expuso y demostró en esta tesis. Por ello se ha propuesto
modificar la legislación para sancionarlos severamente y en concordancia con
la gravedad de sus delitos
