La presente investigación tuvo como objetivo general: Analizar si existe
responsabilidad administrativa por parte de los influencers en caso comentan actos
de competencia desleal por medio de la publicidad digital, en ese sentido se analizó
bajo qué supuestos un influencer comete actos de competencia desleal por medio
de la publicidad digital, así también si el decreto legislativo N° 1044 es aplicable a
los influencers al momento de determinar su responsabilidad en casos de
competencia desleal a través de la publicidad digital, y también si los influencers
pueden ser considerados de forma expresa como agencias de publicidad, medios
de comunicación o anunciantes en el D. Leg 1044.
En cuanto a la metodología, fue una investigación básica de tipo aplicada, con un
diseño exploratorio, con un enfoque cualitativo, no experimental, de corte
transversal, bajo el método de investigación a la teoría fundamentada. Para realizar
la recolección de los datos, se usó como técnica a la entrevista y como instrumento
a la guía de entrevista, por medio de la cual se obtuvieron los datos que se ven
reflejados en los resultados contrastados con los antecedentes, teóricas y bases de
la investigación en la parte de resultados y discusión.
Por último, se llegó a concluir que el influencer tendría responsabilidad
administrativa en caso cometa actos de competencia desleal por medio de sus
redes sociales, y la LRDC en base a una interpretación teleológica podría ser
aplicable tal y como se encuentra redactada hoy en día, pero con fines de otorgar
una mayor seguridad jurídica al tema, creemos conveniente modificar el artículo 59°
de la LRCD al considera dentro de las definiciones de agencia
