La presente tesis titulada “La responsabilidad civil de los jueces por culpa
inexcusable en el distrito judicial de Lima – Centro en el año 2016, tuvo como
objetivo general analizar la valoración jurídica que otorgan los operadores de
justicia a la Responsabilidad Civil de los Jueces por culpa inexcusable en el
distrito Judicial de Lima-Centro en el año 2016.
El tipo de investigación fue básica, el diseño fue la teoría fundamentada de corte
transversal-correlacional. La población para la aplicación de la técnica encuesta
estuvo constituida por 50 magistrados, entre jueces y especialistas legales; de los
cuales tomé como muestra a 08 de ellos; asimismo para la aplicación de la
técnica encuesta la población fue de 80 litigantes de los cuales para la muestra
tomé a 25 de ellos. Para la técnica de la entrevista se aplicó el instrumento de la
guía de entrevista, compuesta por 5 preguntas; y para la técnica de encuesta se
utilizó el instrumento del cuestionario con 10 items, las mismas que sirvieron para
recoger información y responder a las preguntas de investigación de la presente
tesis.
En la investigación, se ha encontrado que los operadores de justicia le otorgan un
bajo valor jurídico a la responsabilidad civil por culpa inexcusable, esto se
corrobora a partir de los resultados obtenidos en esta investigación, donde un
82.5% manifiestan lo mencionado anteriormente y solo un 17.5% dicen lo
contrario. Finalmente con esta tesis se ha encontrado que las causas por la que
un litigante no demanda a un juez que haya incurrido en culpa inexcusable es por
la falta de conocimiento y por la falta de una norma específica.
