El presente trabajo de investigación, tiene por finalidad de analizar como el efecto
suspensivo de las resoluciones impugnadas del recurso de casación civil garantiza la
finalidad de dicho medio impugnatorio; y si paralelamente a ello, se vulneran derechos de
los litigantes, frente a actuaciones maliciosas con fines extraprocesales; por ende, en la
investigación se analizó de qué manera se ve afectado la finalidad del recurso de casación
civil. El desarrollo de la investigación siguió un enfoque cualitativo, de tipo básica,
descriptivo y observacional siguiendo el diseño Teoría Fundamentada, utilizo el
instrumento como la guía de entrevistas y análisis documentarios. Se concluye que, en la
actualidad el recurso de casación civil viene siendo mal utilizado, puesto que, su efecto
suspensivo cumple una finalidad de dilación de los procesos, en contrario a su real
propósito de prevalecer la cosa juzgada, vulnerando la tutela jurisdiccional efectiva y
derechos conexos, además de afectar la eficacia del recurso y desvirtuando su real fin de
coherencia de las resoluciones judiciales.
