El presente trabajo tiene como tiene como objetivo general, determinar la “Vulneración” del
derecho a procrear a consecuencia de la no regularización de la “ovodonación” en el Perú, en
cuanto se busca describir la vulneración del derecho a procrear referente a la infertilidad a
consecuencia de la no regulación del proceso de ovodonación y analizar a vulneración del
derecho a procrear referente a la reproducción asistida a consecuencia de la no regulación del
proceso de ovodonación referente a la Ovulación y Ovodonación considerando a esta como
como un acto que vulneraria el derecho a procrear, tomando como el condicionante de dicha
vulneración al artículo 7° de la Ley General de Salud; donde el tipo de investigación a emplear
es del tipo no experimental descriptiva dentro del enfoque cualitativo de investigación acción,
teniendo en cuenta las variables vulneración del derecho a procrear y la no regularización de la
ovodonación, empleando entrevista estructurada y ficha de análisis de norma, obteniendo como
resultado que si se evidencia la vulneración del derecho a procrear mediante la no regularización
de la ovodonación, lo cual genera vacíos legales que garantizan “protección” jurídica a aquellas
mujeres que no pueden procrear de una forma natural; concluyendo que La vulneración del
derecho a procrear se rige en base a un vacío legal y social por la falta de regulación de la
ovodonación, lo cual al ser practicado como una solución de infertilidad, se encuentra
condicionado conforme a que no se permite el mismo por los presupuestos de madre genética y
madre gestante.
