La presente investigación está enfocada en la aplicación del principio de
oportunidad en el proceso de omisión a la asistencia familiar y su afectación al
derecho alimentario de los menores, dicha figura jurídica es una salida alternativa
del conflicto dentro de los procesos de omisión a la asistencia familiar,
desarrollando como objetivo determinar si la aplicación del principio de oportunidad
en los procesos de omisión a la asistencia familiar garantiza el derecho alimentario
del menor.
Alcanzando como resultado que, la mayoría de los entrevistados señalan que debe
de aplicarse el principio de oportunidad en los procesos de omisión a la asistencia
familiar; que garantiza en derecho alimentarios, pero cuando es aplicado por única
vez, concluyendo que, la aplicación del principio de oportunidad en los procesos de
omisión a la asistencia familiar garantiza el derecho alimentario del menor, siempre
y cuando sea aplicado por primera vez, mientras que, cuando es aplicado por
segunda vez, si quebranta el derecho de alimentación del menor, esto es porque,
el alimentante se sujeta a incursionar a un proceso penal y esperar arribar a otro
principio de oportunidad lo que hace que el interés superior del menor no se
respecte.
