Influencia de la Ley N° 26864 en la reelección inmediata de alcaldes y la vulneración del art. 194 de la Carta Magna del Perú, 2015 – 2021

La investigación tuvo como objetivo general determinar en el art. 6 de la Ley N°
26864 de Elecciones Municipales, influye en la reelección inmediata de candidatos
municipales, que está prohibida en el art. 194 de la Constitución Política del Perú,
2015-2021. La metodología fue de enfoque cualitativo, tipo básica y el diseño
correspondió a la teoría fundamenta, se conformó 6 participantes expertos en
derecho municipal y constitucional a quienes les fue aplicado la guía de entrevista.
En ese sentido, se concluyó que la prohibición de la reelección consiste en que una
persona siendo alcalde municipal no puede postular al mismo cargo de manera
inmediata luego de haber finalizado su gestión, por lo cual tienen que esperar que
haya pasado cuatro años para volver a postular. Por otro lado, se encontró que
efectivamente existe una influencia del art. 6 de la Ley N°26864, debido a que por
medio del domicilio múltiple se habilita al candidato a postular en una diferente
circunscripción territorial. Por otro lado, se sugiere a los congresistas del Perú a que
puedan plantear Proyectos de Ley que modifiquen el art.6 de la Ley 26864 a fin de
se prohíba la aplicación del art. 35 del Código Civil (domicilio múltiple) en aras de
evitar que los candidatos a los sillones municipales puedan postular a una diferente
circunscripción territorial.
