La presente tesis, esta basada en la gran deficiencia que existe en el sistema de
justicia penal peruano, pues en la practica se restringen indebidamente libertades
constitucionales sin el cumplimiento de la taxativa exigencia constitucional de la
aplicación adecuada de la ponderación frente a la contraposición de principios que
se presenta cada vez que el estado aplica el ius punendi mediante sus órganos de
justicia. En tal sentido, estas falencias del sistema vienen afectando las bases
constitucionales de nuestro estado de derecho, ya que un estado no puede ser
considerado uno de derecho, cuando sus órganos de justicia aplican restricciones
a derechos fundamentales desproporcionadas, con resoluciones que no realizan un
adecuado examen de ponderación o que inclusive omiten groseramente su vital
argumentación.
Con base en ello, la presente investigación tuvo como objetivo general: Analizar qué
criterios de racionalidad advierten los magistrados en la aplicación de la
ponderación frente a la determinación de la debida medida de cumplimiento de los
principios contrapuestos, en el Proceso Penal Peruano, 2020.
La metodología empleada partió de un enfoque cualitativo, de tipo básico,
fenomenológica empleando el método naturalista, inductivo y descriptivo; los cuales
fueron proyectados en fuentes documentales y en estudio de casos en giro
