Los medios de comunicación frente a la aplicación de la prisión preventiva en el Nuevo Código Procesal Penal Peruano

El presente trabajo, tiene por objeto de estudio desarrollar el análisis de como los
medios de comunicación generan los llamados “Juicios Paralelos" los cuales
influyen en la sociedad y a su vez estos distorsionan y elaboran campañas
mediáticas que intentan presionar o influenciar en la decisión del fallo o la
conducción del proceso , en el momento que el juez aplica la medida cautelar de
la prisión preventiva estipulado en el artículo N° 268 de nuestro NCPP ; es así que
su objetivo general de estudio, es determinar la forma en que la influyen en nuestras
autoridades, si le brinda la adecuada protección o se lesiona los derechos
fundamentales de las personas y el impacto que esta genera en nuestra sociedad;
el tipo de estudio corresponde al enfoque cualitativo , dirigido a la comprensión para
el análisis del tema se ha utilizado mecanismos de recolección de datos como las
entrevistas, las cuales ha sido dirigidos a profesionales del derecho, tales preguntas
enfocadas a resolver el problema principal y específicos, el cual está básicamente
enfocado a demostrar de qué manera los medios de comunicación influyen en
nuestras autoridades judiciales y si las normas se encuentran correctamente
interpretadas, o si existe una sanción adecuada a los medios de comunicación o
límites al ejercicio de la función periodística que vayan de acuerdo a los parámetros
; dejando en claro que no se pretende la creación de nuevas leyes ni la derogación
de las existentes, sino demostrar que no basta con las mismas, si es que no existe
coordinación entre las instituciones para que se brinde una adecuada información
y una protección suficiente a los derechos fundamentales de las personas.
