La presente investigación está enfocado en determinar si las normas que regulan
el uso de la fuerza en efectivos policiales en casos de abuso de autoridad tienen
implicancias en una afectación al derecho de los miembros de la Policía Nacional
del Perú, ya que en cumplimiento de su función constitucional realizan
intervenciones, por control de identidad, en caso se haya cometido algún ilícito
penal, alteración del orden público, entre otros, cumpliendo los protocolos
establecidos en las normas nacionales e internacionales, y producto de estas
intervenciones cuando las personas oponen resistencia se causan lesiones, ante
estos hechos muchas veces los efectivos policiales son procesados penalmente
por el delito de abuso de autoridad, siendo un factor importante la valoración de los
elementos de prueba. Asimismo, se concluyó que en los casos de abuso de
autoridad se deben verificar detalladamente las actas formuladas por los efectivos
policiales, el reconocimiento médico legal de los presuntos agraviados, entre otras
pruebas que sirvan para determinar si estamos en un caso de abuso de autoridad
o no.
