La facultad discrecional y el derecho al secreto bancario en el marco del Decreto Supremo N° 009-2021-MEF

La facultad discrecional es una potestad con la que cuentan ciertas entidades de la
Administración Pública, en ejecución de principios y criterios razonables del
derecho. En el presente estudio, se analiza de qué manera la facultad discrecional
aplicada en el Decreto Supremo N° 009-2021-MEF vulnera el derecho al secreto
bancario en el Perú; la metodología que se empleó es de enfoque cualitativo, tipo
básica y el diseño aplicado: teoría fundamentada – sistemática. Como resultado se
obtuvo que el decreto motivo de estudio, estaría vulnerando el derecho al secreto
bancario, en razón de una inconstitucional aplicación de la norma con rango de
inferior jerarquía que la Constitución, ya que en su creación habría obviado los
principios de proporcionalidad, razonabilidad y justicia, elementos fundamentales
para la aplicación de la discrecionalidad; efectuando así una indebida aplicación de
la libertad jurídica, al sobreponer un decreto por encima de la Constitución.
Concluyendo así con la inconstitucionalidad de la norma, la carencia de cultura
tributaria y la atribución de sospechosos de versar en algún delito tributario que le
estaría otorgando la norma con su ejercicio, evidenciando la vulneración de los
artículos 2 numeral 5 segundo párrafo y 51 de la Constitución Política del Perú.
