El principio de oralidad y su eficacia en el proceso civil peruano año 2020

Desde los inicios de la República y en armonía con los sistemas procesales extranjeros como de España e Italia, ha sido tradicional en el país el uso de la escritura para sustentar todo tipo de proceso legal en los asuntos jurídicos que se ventilan en sede judicial. Sin embargo, en los últimos años nuestro sistema judicial se ha imbuido de cambios propositivos que derivan de un proceso de modernización de la justicia, en la medida que se adoptaron nuevos procedimientos para hacer mucho más dinámico, flexible y eficaz los procesos judiciales.
Dentro de dichos cambios, se ha incorporado la oralidad como principio fundamental del proceso, así también, como una técnica de litigación que favorece la aplicación de los principios de inmediación y economía procesal, al reducir sustantivamente los actos procesales, generando cambios favorables en el desarrollo de las audiencias en sede judicial; y beneficiando a los litigantes en la búsqueda de obtener justicia a partir de una adecuada gestión del proceso judicial a cargo del magistrado. De otro lado, la oralidad genera una mayor eficacia en el comportamiento y conducta procesal de los abogados; y también los compele a tener una mejor performance como letrados a cargo de una causa, en la medida que un proceso oral demanda un mayor empleo del factor cognoscitivo, al tener que estudiar concienzudamente cada caso sometido a su defensa, lo que favorece de manera adicional, su nivel intelectual.
En nuestro país, la aplicación de la oralidad en el proceso civil no está debidamente tipificado en las normas que regulan los procesos civiles sino que su empleo es una medida discrecional del Poder Judicial, quienes han adoptado la decisión de emplear la oralidad, tal como se emplea en los procesos penales y laborales entre otro, de manera que sin intervención del Poder Legislativo, nuestro proceso civil al emplear la Oralidad, está optimizando el sistema de justicia y alcanzar la solución de controversias en plazos razonables.
