Responsabilidad civil de los jueces y el derecho al resarcimiento provenientes de sentencias por actos terroristas en Perú, 2021

En el presente trabajo de investigación se buscó determinar de qué manera se
configura la responsabilidad civil de los jueces frente a la omisión del derecho al
resarcimiento provenientes de las sentencias por actos terroristas. La
metodología utilizada corresponde a un enfoque cualitativo, cuyo tipo de
investigación fue básica y el diseño de teoría fundamentada. En ella se aplicaron
las técnicas de análisis documental y las entrevistas, los mismos que permitieron
el desarrollo de los objetivos planteados. En los resultados se obtuvo que, existen
vacíos legales para valorar un monto adecuado que otorgue una reparación
equivalente y restaurativa para las víctimas de sentencias por actos terroristas,
además que, la responsabilidad civil del juez, es excesivamente protegida por el
Estado. Se llego a concluir que, los jueces incumplieron una obligación funcional
al denegar, una reparación civil restaurativa y equivalente para las víctimas de
actos terroristas, donde, la corte interamericana de derechos humanos, encontró
al estado peruano culpable de omitir un derecho fundamental. En ese sentido, los
jueces deberían considerar más, la valoración de las pruebas de oficio, también
ceñirse al plazo razonable del debido proceso. Finalmente, llevar capacitaciones
periódicas, a fin de, garantizar una adecuada aplicación de la ley.
