Causas que determinan la imposición del monto diminuto de la reparación civil en los casos de violencia familiar en el Juzgado Especializado de Familia de Tarapoto - 2010

La violencia familiar es un problema social y común en la actualidad, las mujeres se
ven afectadas por causa de acciones violentas por parte del padre o jefe de la familia
ya que en una sociedad patriarcal la mujer es considerada como el sexo débil y/ o
inferior frente al varón, legitimada desde la familia y reforzada por la actitud "pasiva y
escéptica" que asumen las mujeres víctimas de violencia.
Con el estudio de la presente tesis se logró identificar la incidencia de violencia
familiar y medidas a adoptarse para su corrección, en aplicación de la nonnatividad
adecuada, sin embargo la violencia es cada vez más frecuente en nuestra sociedad.
Los tipos de daños que se han identificado son mayormente el daño fisico y
psicológico que le es ocasionada a la víctima por lo que debe ser indemnizado no
necesariamente con fines de lucro sino con el fin de cumplir con los tratamientos de
la víctima llámese tratamiento psicológico que requiera la misma.
El punto de investigación es identificar las causas que determinan la imposición del
monto diminuto de la reparación civil que el Juez impone, teniendo en cuenta que
una de ellas es la falta de consideración por parte del juez, la inaplicación de la
nonnatividad relativa a identificar el daño ya que las Sentencias, emitidas en los
procesos de violencia familiar, carecen de una debida motivación con respecto a la
reparación del daño en beneficio de la agraviada, la falta de valoración de medios
probatorios y la falta de aporte de medios probatorios por parte de la víctima.
La reparación civil se fundamenta en la necesidad de encontrar mecanismos para
proteger los derechos fundamentales de la mujer en el hogar frente a los cotidianos
maltratos, insultos, humillaciones que se producen en el ámbito de las relaciones
familiares ya que pese a obtener los medios probatorios en cada caso, el juez no
considera que la reparación del daño deba ser en función a la gravedad de la agresión
y a las me<l.idll.s de protección dispuestas, sino a que el agresor lo pueda pagar.
